Written procedure

In written procedure, the referendary circulates, among the members of the court of appeal who belong to the deciding composition, the decision of the district court, the appeal, the response, the other material compiled in the court of appeal, a draft decision and perhaps a memorandum that he or she has written.

Afterwards, a session with a quorum convenes in a presentation, where the referendary summarises the case orally. The members discuss the case and finally, in turn, state their opinion. If necessary, a vote is taken.

The parties and the public cannot be present in a presentation in the court of appeal.

The court of appeal sends copies of the decision to the appellant and the respondent. In addition, a copy will be sent to the defendant in a criminal case also otherwise, if the decision of the district court has been altered in a manner relevant to him or her.
